Hi, I am currently in Student visa (F1 ) in OPT. I have filed 1040 instead of 1040NR. And I have got stimulus package for which I am not eligible as I am a Non resident for tax purposes. So how do I fix this problem? Any help please?

When filing form 1040 for dual status tax year, do I claim my dependent for the whole year. Do I also claim charitable contributions and HSA for the whole year. Then fill out form 1040nr using figures that relate to the non resident part of the year?:confused:

Hello, I believe that all students who are on F1 visa have to file as non-residents. If a person is a student and his/her spouse is a resident (H1-B and valid substantial presence test) can they file taxes as married filing jointly on the resident form (1040). TIA Amit View more questions Search
