    How to answer a Lawsuit notice in Florida
    I have been served for a credit card debt I can not pay as my husband lost his job and has been out of work Since Jan 09. He 67 and not in the best of health so its hard for him to find work and now I'm the only one working. He receives S.S. and a small pension from the fire department. His lost of income has cause me to use my pay check to pay the mortgage. I have always paid my debts on time but now I'm so far behind I can't catch up, I've tried to make payment arrangements but I don't have enough coming in to go around. I went to file bankruptcy and the attorney advised me to just let the credit card companies put a judgment on me instead of doing the bankruptcy. What should I include in the letter to responde to the court and should I submit paystubs and a financial breakdown of my expenses. I appreciate any help, I have to respond by Friday.

    Until someone more knowledgible responds... #1 thing to remember... do NOT blow off the court date. If you do not show up they automatically win a default judgement.

    Just curious, are you as old as your husband? The reason I 'm asking is I can't understand a lawyer telling you to let the cc go to judgements unless you are also receiving social security
    Because that would be exempt meaning that the creditors could not touch your social security Maybe you
    Should speak to another lawyer. Also some of our experts on here can better advise you

    DownUnder: Thank you for your response, My husband is 67, I'm 59. I've responded to the summons and now I guess I'll wait and see if I have to go to court. I submitted a breakdown of our income and expenses and I end up with $74.00 extra each month but that's if I don't buy food.
