    I violated hippa by having father in clients home will I loose my stna
    I ran out of gas I called my father to bring me some at my clients house for home health care, he cut his finger looking for something in his trunk, passed out and ems came checked him out and told him to go sit down, will I loose my certification for this?

    I ran out of gas I called my father to bring me some at my clients house for home health care, he cut his finger looking for something in his trunk, passed out and ems came checked him out and told him to go sit down, my father also after he woke up from passing out vomitted in trash can in house and outside, will I loose my certification for this? I was terminated from home health agency and I have to fill out a termination letter and do an exit interview... I am very worried

    I don't see anywhere that you violated HIPAA? Did you tell them things about your patients condition,
    Did the patient invite father in ?

    I actually believe the company that fired you did so incorrectly.

    First you did not break any HIPAA, so whoever said you did are wrong.
    ** unless you told all of their medical info to dad when he was there.

    If this is a larger corporation, I would ask for a review by higher up management

    But you need to stop saying you vioated it.

    I had my dad sit in the clients home for about 45 minutes but I never discussed my client with him, however I did ask my clients mother once if I could borrow 20 dollars, she then said ask your father to bring the gas is this a violation I was fired for this

    I don't understand why this is posted under corporate law and what the alleged violation was - was telling your father that this particular person was a client the violation?

    You ANSWER your own question to add more info.


    1. it shoulds like you were fired because you bothered a customer,

    2. If all that ahppened is what you said, you did not violate anything

    3. I would appeal the reason for your firing, since it was not for any violation, it was poor customer service, and a bunch of bad luck, but no violation.

    What kind of trouble will I be in?
    Is this a reason to take away my stna certification and was it reason to fire me. I had dad bring gas to clients home. Father only came in because he had cut his finger, passed out and was told to sit down by ems after they came. No information was released to anyone about my client

    Ok, the fact you can't follow our rules, and can't even follow our instructions, yes, you most likely did something wrong and don't know what you did. And if you can't follow instructions here I doubt you did on your job either,

    You were asked over 6 times to stop posting new questions, you refuse to do that, but ask the same question over and over,

    We asked for more info and you refuse to do that.

    Without a doubt you violated the rules of your employer and undoubtedly the rules of HIPAA.

    You simply can't understand how this site works; you probably aren't even close to figuring out HIPAA (let alone following your employer's instructions).

    If you called your father and gave him your client's address this would be a HIPAA violation, even though you didn't share details of the client's condition. Whether he came into the house or not is immaterial -- the mere identification of this person being your client to a 3rd party (your father) is a violation. HOWEVER, if the client asked you to call your father to have him come to the home, then you have an argument that the client gave you permission to share this information. Ideally you should have obtained a signed release from the client before calling your father. So I suspect you were fired for violating company policy on this type of thing, but in reality the client has little to no basis for actually suing either you or your former employer.
