    Fica tax return f1 status
I am an f-1 student who was doing OPT all 2009. My employer charged me social security and medicare taxes. I know that as F1 student I was exempt to pay those taxes. I explained that to my employer, but he said that when I declare my taxes with the IRS I am going to get those back. Now, I am going to declare my taxes in February and I want the money of those taxes back. What should I do before of the IRS?

First file your tax return without doing any thing about FICA taxes as nonresident.

Then after about 2 months file Form 843: Your U.S. Tax Return: Social Security and Medicare (FICA) Taxes for Non-resident Exempt Individual
