    I was sued by a Collection Agency(Palisades) through their Lawyer (Borack&Associates).
    I was sued by a Collection Agency(Palisades) through their Lawyer (Borack&Associates).I answer the summons and filed Discovery and production of documents... aswell a Motion to Dismiss without prejudice since there was never attached a proof of the debt to the original summons. The hearing is coming up for the Motion to Dismiss although the plaintiff has requested the court for TELEPHONIC HEARING and was granted.(I need to go in person to court but they will be just in the phone)I don't understand how they will present proof of debt by phone.A swon statement I think is not valid in this case... since I have requested several times for phisical proof of ownership of debt;which until today has not been presented.Is it safe to go ahead with the TELEPHONIC HEARING or should I OBJECT to it.Thank u

    Should be combined with other thread - all the same situation.

    Do you have to consent to a telephonic hearing or is the request automatically granted in your State?

    It was granted by the judge... in the Florida procedural rules... states that anyone have the right to ask for Telephonic Appearance... although I as a Defendant have the right to object to it.

    I just do not know if is relevant even for me to object... or you think the Plaintiff might have a hidden agenda?. Plaintiff states that is unduly for the distance to travel to the courthouse... that is the reasoning behind their request.

    I would believe there is no hidden agenda - it's probably a matter of distance.
