If going through a divorce and was living with spouce in Texas when I was deployed she left and moved in with her boyfriend with my children and I pay all child support she has a restraning order on me and now trying to get me for abandenment when I returned to the states with no home, no clothes, no children, no car but yet I abanded them when I was serving my country. And doing my job to come home to nothing not even ahome and she moved to Tennesee what is up with this and now stationed in another state how is it that I abanded them. I want to see them but she won't let me if I call she wants to argue in front of them they don't need that. I am sick of the crap and now she wants to take my parental rights away. But she wants the old mighty dollar which I will pay for my children but I want to see them with out her interfering. Can they do this?

You need to get an attorney involved. I am not sure, but it is possible that JAG may help you in this situation.

Since you were serving your country she can't get you for anthing. Also your paying your support, again she is wrong. Why is there a restraining order in place? Also you need to fight in the court system and get court ordered visitation and she either work with the courts or give up the kids.
Try the JAG office or a private lawyer but either way don't try this yourself because your children are at stake.

First why is there a restraining order.

But abondament is a reason for divorce not a criminal charge, unless you left the kids sitting at walmart and drove off.

But for divorce it is a reason that you left and did not support the family.

Next is child support ordered, it is not abandament if you are paying court ordered child support.

Restraning order was put there cause she accused me of being abuseive but I never was and she thought she needed it since I waas coming home and her living with another man. But I was sick of all the fighting with her and her lies that I am glad she is gone but not my children. They are 6 and 3 and I never hit her or any thing but I think that she thought I may since she moved the way she did and still wants to argue with me. I have always paid her money even before it was court ordered that way she could not say that I did not support my family. Which she did try but I had proof that I did siupport her and my children. But now she is trying this step to keepme from seeing them. Even though I pay my support.

You will need to file for visititation in the court, does not matter what she wants, even if you were a wife beating drug addict you would get at least supervised visits.
