    What is the legal procudure to break a lease in Florida because of roaches?

    Hello c:

    You can't break a lease in Florida because of roaches. You MAY be able to break the lease if your landlord doesn't address the issue. In order to prove in a court of law, that he DIDN'T, you're going to need to create a paper trail. In other words, don't CALL him about the problem. Write him a certified letter.

    You inform the landlord, in writing, of the problem. If the landlord doesn't take action within a reasonable time (about a week), then you file a complaint with the local health or building department. If they issue an order and it still is not complied with, then you can inform the landlord that since he has not maintained a habitable home and you consider him in breach and are terminating your lease within 30 days.

    But don't be too sure you will be able to break the lease. A lot depends on the nature of the premises, single family home, 2-3 family home, apartment building, etc. Also how long have you been there?

    And be sure to review the wording of your lease to see whether you or your landlord is responsible for pest control.
