Daughter got caught shoplifting she's under 18 will this go on her record
My daughter and her sister was caught shoplifting, They gave her a ticket and she was told to pay 100.00 but yet she has a court date. They were not taken downtown to the police department. Could this show up on her criminal record.

We take pride in our "legal" answers to legal questions.
What you have posted is not true to the best of my knowledge.
What is your source?
The ticket could well disposed of in some other way, with no "permanent" record.

A ticket is normally for a city law or code violation and/or other misdemeanors. Normally these will be in the local court record but not go into any national data base.
Now if she runs for president I am sure someone will find the record or interview the officer who wrote the ticket.

My "source" is previous experience for myself and a few friends... unless you are invited by a district attorney to enter a program to have it taken off your record (which they only usually do for felonies then it will stay on her record until she is 18 (which is when all records are cleaned for a minor unless it's a felony)

There are many ways to handle this situation. It doesn't always lead to a guilty plea and/or a permanent record. Need more information as well as what State OP is in.
Also depends on her background, previous arrests, how willing the DA is to "deal."

Yes it does depend on the state and it depends on if they are even going to fight the ticket. And a small thing like this doesn't usually involve a district attorney... go to juvenile court pay the ticket and be done with it

It sounds like she received a simple citation. I wouldn't worry too much over it. However, if your locality does consider it a charge you may wish to speak with the DA about having her record sealed. Not everything gets sealed just because someone turns 18. I know from personal experience. I was young and dumb once. When I was 23 something was still showing from when I was 15.

A 17 year old is charged as an adult in a lot of places, sometimes 16 it depends on the state. Like others said find out if it's a misdemeanor or a local ordinance. Either way maybe either of them can be sealed once she 18.

One easy way, if she has to go to JUV court, then she is charged as a juv and those records are sealed in the US at 18. If she is going to city court, it is a citation and there will be a city record but not normally on national data base.
