Evicting roommate who IS on lease, but does not pay ANYTHING
I have been supporting my roommate for a better part of 6 months, almost completely. She had a job when we came to hold the apt. she lost her job, and half heartedly looked for a long time. We just moved in here in September, she signed the lease along with me. From August until now, I have been fully supporting her, bought her a phone, put time on it, she used and old phone of mine, on my moms plan, and went over by 250.00, has given me 150.00 in 5 months. I feed her, get her cigarettes, electric, heat, ac, net, phone. She has no phone on mine now. Anyway... I am a single mom, I do not get Food stamps! I do not get cash assistance. I have a daughter on disability, which helps, but still, this woman is not family, my partner, she is nothing to me, but someone who needed help, and I helped her because I felt bad for her baby, to which was removed from her care. She's not paying even half of what she owes me, she took today's check and spent all of it before I even knew she had even gotten it. I take her back and forth to her job... which she only works 2 hrs , 2-3 days a week at. Im so angry, she's got a nice private room while I share a room with my girls. Her own bathroom. Laundry. Food. Smokes. Whatever. How do I get this moocher out of my house and my life!! I need to get her out. And very soon. I refuse to pay anymore for her.

Sorry, she is on the lease, you can't evict her, you can sue her in court for her share of the rents.

Im not just paying her portion of rent, Im paying for everything for her, up till very recently. She brings men from the net to my kids home, which puts us all at risk of some psycho or another, and has brought too much chaos and drama into my life. I want her out of my life. I helped her as a friend. Why is it victims have less rights than criminals do?

If it were ME, I wouldn't BE a victim. That is, of course, unless she holds a gun to your head MAKING you pay for "everything"... Nope, you're a WILLING victim, and unless you stand up for yourself, nobody is going to help you...
It's TRUE, you MUST pay the rent, because if you don't, YOU'LL suffer. But, you don't have to put food in her mouth. Nope - not at all.

Ive taken everything away from her, and feeding her is a moral decision. I told her to leave, funny law I found, if a party removes their belongings, willingly or from court decision, they no longer have a right to a key, regardless if on the lease or not. Ive removed all toileteries, locked up laundry stuff, put a lock on my bedroom door, I lock the top bolt at night time, she can't get in, since she has been staying somewhere else as well. If she comes in and eats, she does so when I haven't been home... Im changing the locks, and letting the court decided. Yes, Excon, I was a willing victim, I allowed it, because this girl is... quite immature and irresponsible. I didn't ask for all of this when I moved her in, and as much as I tried to help her, can't help someone who isn't willing to help themselves. The past 2 months, I have been looking for answers, to get her out of my home, and have been getting the same responses.. and Im not going to not pay the rent because she doesn't want to pay, or can't pay. I am taking her to court and suing her for her share of the rent, I will not be getting it. I know this girl. And I have been victimized... I forget the name of it... she deceived me. In big ways. And I'm done with it. Ive made it so hard for her she won't even stay here. But she still comes in when no one is here and does whatever. Creepy.

And the minute you change the locks you have broken the law, I hope it does not come back ot bite you, giving her a reason to sue you.
Unless she agreed to move out.
Since she is still on the lease, she can legally enter even if that means being more aggressive in entering if you lock her out.

She won't be for long, and she can sue me all she wants... I'm taking her to court already for the unpaid rent. She doesn't make the kind of money for the fees, and she has burned her bridge at every corner she's turned, she willingly changed her mailing address, and has removed all her items. If she removes anything of Mine, another story. So suing her and getting her off my lease is my second step. Ive also got rights and Im ready to get this done and over with.

Yes you do have rights, but you can't enforce your rights by trampling on hers.
What you SHOULD have done is go to your landlord and work with them to evict her.
By changing the lock you have illegally evicted her. If she goes to court and tells the judge you did this, you could find yourself on the losing end.

Yes, you could end up writing her a fairly large check at the end of court, if she decides to counter sue you.
I guess hope she does not come here for advice ( lol)
There is a legal way to do things, it may not seem fair, it may not even seem right, but it is the only legal way to properly do things.

I don't think she will have to countersue. If she just tells the judge that she was locked out without proper notce or court action, the judge is likely to say there were off setting penalties so neither party gets anything.
