My mother is 76 years old and my brother has been living with her for 12 years. He is 46years old. He will not work. My mother cries and wants him gone. Even though he has helped her with the house and yard work, he uses her car, spends her money, eats her food, etc. She is always broke and cannot pay her own bills. All she has is her social security money.

What is the law in Texas to evict an adult child that has resided with his mother for 12 years? She has asked him to leave many, many times and he will not. My brother tells me that he is her caretaker and that he has rights.

Any advice would be greatly appreciated.

He's the same as any other tenant. She needs to evict him according to Texas Law.

How is he "spending" your moms money, sounds like she is giving him her money, so why ? She can just not give him any money?? Or is he stealing it in the middle of the night ?



If mom is paying him to be a care giver, she just fires him, care givers come and go all the time.

The only right he has is a written notice before he gets evicted.
