    Put family member out of house
    We want to put our son out. He is 24, pays no rent, doesn't follow our rules, disrespectful, and curses us all the time. He has recently hit his father and has threatened to hit me. Can we put him out with out getting or giving him a eviction notice. We live in Va.

    No. If he voluntarily leaves that's a different story. If he hits you or your husband again have him arrested. Then when he's in jail have a restraining order taken out against him and this would bar him from setting foot in your home again. OR

    You could file formal eviction papers on him and more than likely he'll blow his top and start pounding on you or your husband or wrecking/pounding on the house. In that case, call the cops ASAP and have him carted off.

    Either way, there is NO quick, easy fix to your situation.

    When is his court date after you called the police and had him arrested for hitting his father ?

    Using that police report and your testomony that he threatened you, what you do is get a order of protection, and he can't return home.

    Next if none of that can be done, yes you are legally suppose to get a eviction.

    *** Ok, this is where I give some other advice, so what if you illegally evict him, change the locks and throw his stuff to the curb. He gets to sue you for the eviction if he wants to.
    But my personal opinoiin, not legal one, my safety is more important than anything, so first and above all you do what ever you have to do, to be safe.
