    Letter of testamentary
    My wife is the only aier of her mother in a medical malpractice suit and they need aletter of testamentary how would she go about getting that and what is it exactlyis it. Thank you

    The executor of the estate is the one who has the letters testamentary. It is issued to the executor when the estate is probated. If the estate hasn't been probated yet then you have to do that first. If there is no will and your wife is the only heir then she should be issued the letters testamentary.
