    Can the IRS garnishee Social Security checks?

    No except for child support and certain student loans.

    If the check is deposted in an account and co-mingled with other funds, yes, it can be seized.

    Thank you. Then it may be best to just cash that check each month and not open an bank account?

    Or, can the IRS garnishee a social security check before it is sent to the beneficiary?

    This is my fault - I totally misread your question. Sorry. I mised the IRS part. If you use the "search AMHD" feature you will see that several people have had liens placed by IRS against their SS and the liens have been honored.

    Wow. That scares me. SS is the only income I have now. My business is quickly failing. Won't last another 30 days.

    Can the IRS take all of my SS? Or just a portion of it?

    If you do not take affirmative action, then, yes, the IRS CAN garnish your Social Security check.

    However, if you definitively show that the Social Security check is in fact your only income source, and that said garnishment would cause you to become destitute, you can stop the garnishment from happening.

    A phone call to the Tax Advocate's office in the IRS should yield the information you will need to stop the garnishment.
