Last week I created a thread "possible law suit" & it got closed. Here's a update. I did talk to 5 lawyers. Only one will take the case. He says I might get a little more money but no guarantees. From what they say this is a min whiplash case with no permanent injuries & 3k for p&s is fair. The at fault ins co rep will not budge above 3k for general damages. My med bills are $3710.00. I did agree to the settlement offer verbally last week but I still haven't signed the papers yet. If I email the adjuster & tell him I changed my mind what will happen ? I think 4-5k is more resonable. The ins rep acts like he's doing me a favor & his attitude towards me is rude. I did contact my medical billing dept & they said they would reduce the med bills to 3k if the insurance co agrees to give me the diff ($700.00). The claims adjuster said no. Should I just take the money & move on ?

Seeing as how your neighbor made out on her accident - as Excon put it in the other tread - it should have nothing to do with YOUR accident.

You said you have no permanent injuries. You said you've had nightmares. You don't get a gazillion dollars from nightmares. Sorry. You don't get a gazillion dollars from nonpermanent injuries either.

Take the offer and run before they change their minds.

If you do decide to retain an attorney and file a PI case, it could be YEARS before you see a dime from the case. Are you willing to spend that much time on a maybe I'll win a tad more if I take them to court? Probably not. In fact, you could lose your p&s totally and/or lose your case entirely. Once you start suing an insurance company then they hire their defense attorneys who will rip through your medical records with a Mack truck hoping to find that niggling little item that could negate your case or work against you. I worked for insurance defense attorneys on very large accident cases and very small accident cases. They don't want the insurance company to pay out a dime extra that they don't absolutely have to.

In your case, you're ahead of the game now. Do you want to really keep grabbing for money that probably won't appear when all is said and done?

Also, attorneys take 33 1/3 prior to trial and 40% if the matter goes to trial plus expenses. Sure, you don't pay anything up front, but you sure do get to pay once there has been a settlement or trial in the matter.

This is exactly the reason the thread was closed in the first place - all of this has been asked and answered. Maybe you don't like the answers but you were given the legal facts.

I think this thread should also be closed - I see nothing new posted.
