How do I get my ex`s rights taken away? My daughter is 17 months now and he's hasn't seen her since she was 3 months. He is in and out of prison and I just want his rights taken away. How would I do this? Please help me.

Are you married to someone else? The easiest way (that I know) is to be married to someone else, and have them adopt your daughter, and have your ex sign away his rights.

Chances of you taking his rights away (or a court... you can't do anything) are slim unless he has actually harmed the child...

If he doesn't see the child taking his rights away does nothing anyway.

What is your goal? What do you hope to accomplish?

I'm curious, when you opened this forum to post your question did you happen to notice the "Signing over rights-Read First" post? Did you try browsing through some of the other questions? If not, why not?

If you had, you would have gotten an answer to your question. There are THOUSANDS of threads here all asking the same or similar question. That's why I posted the sticky note which provides the answers.

Why do you want his rights taken away? Since he hasn't had any contact, what do you think that will gain you?

But the bottom line is courts are VERY reluctant to grant a TPR. They will generally only do so to clear the way for an adoption or if the parent represents a danger to the child. If he's in and out of jail you might be able to get it on that depending on the offense. But frankly, I wouldn't bother. What I would do is make sure you have SOLE legal custody and he has no visitation rights.

He doesn't see her cause he's in prison and we live in two different states, he is also a registered sex offender. He may not have hurt my daughter but he may and I don't want to take that chance. So him being a sex offender doesn't matter?

Of course it matters. If you had told us this in your original post, it would have changed our answers.

But I still say, that you should make sure you have sole legal cistody with no visitation. That will be easier to get and will give you the same protection. If he ever tries to see the child, then you can go for a TPR.
