    H1 visa person marrying green card holder -
    Hello

    I am new to forum and not sure where to post this question. I hope I am in right category. I am posting on behalf of my cousin who came here on H1 visa to work for a relative who sponsor him. He is been here for past 10 months and found a girl and they want to get married. She is greencard holder and he is on H1 visa.. Also he is trying to change job on his H1 visa. What is the process and forms he needs to fill out? Also how long it will take for him to get his greencard? Does he have to stay with person who has sponsor him or he can change his job?

    Can you please guide me through the process? Thank You

    After they get married, she must file I-130 relative petition, then he has to wait until priority date is current (about 5 1/2 years) then he must file for adjustment of status.

    He should keep H-1B status during this 5 1/2 years so he can stay and work in the US until priority date is current.

    Thanks for guiding on my questions.

    For H-1B visa - does he have to work for same person who has sponsor his H1B visa? Can he work for someone else if needs or not?

    If the spouse is getting her citizenship in Dec 10does that mean his file will change once again and make his green card call be quicker than 5 yrs?

    If he wants to change jobs, he can have another employer file for the H-1B. Using H portability, he does not need to wait for the approval to begin working with the new petitioner.

    If his wife is naturalized in December, then she can file the relative petition and he can file the AOS concurrently. At the same time, file for an EAD.

    Hi Guys ! I am really new to this forum too. For me the question is " I am holding a green card from past 2 years (since march 2010) .I am going to marry a guy who is here (in USA) from last 2 years holding H1 visa. How long does it take to get green card for him after wedding ? And what kind a procedures or forms we have to fill up? Please reply me asap . I am going to get my citizenship after 3 years though.Hope you guys going to help me.
