    Non Bio father wants rights
    So I was dating a girl that had a baby and since the baby was 3 mo old I have been Daddy he knows me as daddy and I have helped raise him about 3 weeks ago she broke up with me and is now dating someone else. The bio dad wants nothing to do with him and is not on the BC. I want to beable to see my son and continue that relationship not only for me but for him he is the most important thing in the world. He is now almost 18 mo old. What rights do I have if any? Please help!!

    Sorry but you aren't his dad legally speaking. I know that's hard to hear but you have no rights at all you can only have visitation if the mother allows it. I hope for the child's sake that she does allow him to have stable role models but you have no legal grounds for a child that isn't yours.

    You should have married the girl and adopted the child. Since you didn't you have no legal standing.

    I didn't marry her because we are both under age I am only 17 and was 16 when we got together so it will be heart breaking but I know eventually she will no longer let me see him. I feel for him that's the one that is going to get hurt the most.

    It depends on where you live... Some states do recognize "Doctrine of de facto parenthood".
    You may be a de facto parent if:

    * The child is a dependent of the juvenile court.
    * You are or have been taking care of the child every day.
    * You have been acting as the child's parent.
    * You are meeting (or have met) the child's needs for food, shelter, and clothing. You have also met the child's needs for care and affection.
    A de facto parent is one who has assumed the role of a parent on a day-to-day basis. This means that the person has provided emotional support, taken care of the child's physical needs, and given the child affection for a substantial period just as the natural parent would do.
    You may file an application for de facto parent status with the juvenile court.

    As GV said, it depends on local laws. But from what you said, you only acted as the father for 15 months. So, even if your area does have defacto parent laws, you may not qualify.
