Mistake in filing 1040 instead of 1040 NR
Hello,
I am a student with F-1 visa , summer of 2008 I did some research on campus and I got paid, I filed a form 1040 form that later I figured I made a mistake, and I have never filed 8834 form, now please help me out and tell what I should do at the moment. I really need help,
The total income was 3,500.00 dollars and on my W-2 form it is written that the Federal income tax withheld is 353.95 dollars, and State income tax is 52.50.
Also, I remember I filed a New Jersey income tax as well,
By the way, I got refunds from both Texas and New jersey.
Please help me ,

You can file an Amended 1040 form to make corrections to the original form 1040.
Make sure you have a copy of the original 1040 to submit with the amended form and to answer questions from.

Then what about form 1040 NR EZ or 1040 NR? Or what about the form 8834 ?
By the way I am an undergraduate junior, 20 years old. (just said for your information if you need),
Fool I was that I did not keep the copy of my 1040 that I submitted ,
By the way what should I do about the checks that I received ? (I received them about 3 months ago ) I deposited them off already, should I contact IRS and new Jersey tax department or
Tell will let me know later?
Please help me I am very worried about my status,

Ah Now I just found out that I had deposited a check , 409.91 dollars about couple of months ago. I guess the check is from Austin , IRS, as far as I remember there was something written on it about the interest rate, or some like that. Do I have to send a check with the same amount along with 8834, 1040 NR , 1040 X , and a w-2 ticket as soon as possible?
please help me , I am very very worried about my overall status in US, please just provide me with guidance

Here is what you need to do, step-bstep:
1) Call the IRS at 1-800-829-1040 and ask for a tax transcript for 2008. That will contain a complete copy of your tax data, including a line-by-line copy of your 2008 tax return.
2) Once you have the tax transcript, email me at [email protected]. We can prepare the amended return (Form 1040X, Form 1040NR-EZ, Form 8843) for a very reasonable fee. No additional tax should be due,

I got the transcripts.
The amount you cite above ($409.91) does not match the refund amount ($356), so I suspect the $54 difference was the refund from New Jersey.

Nothing; the NJ return does NOT take your non-resident alien status into consideration and therefore does NOT need to amended.

I've been on H1-B visa since October 2007. On 2008, I lived in US for 344 days, so I meet the substantial present test.

This is the first time I file tax so there is all kind of problems.
Ok, I used Taxact to file a 1040A form instead of 1040NR-EZ. Is this a problem? If it is, how do I correct it? I filed my tax on April 22, 2008, which is late, but oh well.
I also filed form 8917 - tuition and fees deduction...

If I earn part of my income on my OPT and part on my H-1, can I use the India deductible of $4500 for my OPT part of the income, and $4850 std deductible for the H1 part of the income?
