State of Indiana seat belt violation
So I was driving and I got pulled over because my boyfriend wasn't wearing his seatbelt. My boyfriend got a $25 ticket. And he doesn't plan on paying it. What happens if he doesn't? He doesn't even have his license yet.
Also, the cop wrote all of my bf's information on my registration and everything he asked us he accused us of lying several times and we didn't lie about anything that we said and he asked me to step out of the car and then he asked if that was my boyfriend and how long we been together and all this information that he shouldn't have needed to know. Can he do that>?

    Hi, beth911!

If your boyfriend got busted for not wearing his seat belt, then I would suggest that he pay the fine for the ticket. If he doesn't, there is the possibility of the monetary amount of the ticket going up and him perhaps receiving a summons to appear in court.

If he was doing something was against the law, then it's best for him to pay the fine in a timely manner, before too much time passes.

Concerning the other things about which you asked, I'm hoping that someone else with more knowledge will come along to address your question.

    Thanks!

    Hello beth:

There IS a procedure you should observe EVERY time you are stopped... Conversing with the cop is something you should NOT do. If I were you, I'd learn to be defensive when a cop stops you. KNOW your rights. OBSERVE your rights...

Having said that, in MOST states, the seatbelt law is a secondary offense... That means they can't stop you for that offense alone. If you live in one of those states, or even if you don't, I'd have your boyfriend go to court and beat the pants off this nosy unprofessional cop.

If your boyfriend doesn't go to court, he plays right into the cops hands... They LOVE it. So, they can turn him down when and if he ever DOES apply for something, or if they find him on your front seat again with a warrant... They'll pull him through the window...

If you detected that I don't like cops... You detected right.

$25 for a seatbelt ticket? I got a ticket for $85 for not wearing a seatbelt in Ohio. I was pulled over by a trooper as I was speeding. Since I was polite about it all he let me off with a warning about speeding but happily nailed me on the seatbelt. I hate seatbelts and don't wear them 100% of the time. Yes, bad Twinks, I know.

I would definitely suggest your boyfriend pay the $25 and consider it a lesson well learned (to buckle up in the future so as to avoid more tickets). When he goes to get his driver's license shortly, I am sure by then there will be a bench warrant out for him for not paying the ticket and he'll be spending time in the can until he can bond out of jail.

Its not the $25 dollars he's worried about. He don't care about paying it but its just the way that the cop was acting about it that made him mad where he didn't want to pay it but he finally did. But we never did get a chance to go down and do anything about the cop like we were supposed to

So, what's keeping you from making a formal complaint, beth911?

    Thanks!
