    Wanting to get married
    Here's my question.my boyfriend and I are wanting to get married.well,recently the state slapped him with childsupport for our 4yr son (they did it because our son gets tenncare).well,how would that affect us?what I mean is when we get married will he still have to pay or what?

    He'll have to notify the Court that he has assumed responsibility for the child or they will continue to collect. I don't know how having the father back will affect your son's tenncare.

    If you two are married he doesn't have to pay child support. In marriage he is already supporting him. He might have to pay any back amounts from before you two get married. Why wait... go jump the broom!

    Well if you're planning on getting married, and he is the biological father, then it will probably be assumed that he is taking on responsibility for your son. They might stop collecting. But if not, the money goes to you, correct? If that's the case, use it as you would to pay the bills and anything else necessary to support yourselves and your child.

    Since you said TENCARE, I will assume you both live in TN. ( USA)

    If you get married he will not have to pay any new child support, but will have to pay any and all back support, esp that to the state.

    TN loves to put people in jail for failure to pay child support

    Tenncare is an insurance program like Medicare.

    Through the court order he is paying part of his child's insurance.

    Sarah, The only way I could see for it to end would be if your child was off their books. Even then, I don't know if it would continue until everything they have covered is paid back.

    Yes, TennCare is a health insurance program through the State of Tennessee.

    Your man will have to repay the government for the use of the TennCare, but he won't have to pay child support.

    Just to make something clear here. When someone gets assistance from the government to pay for the care of a child, the government would like to be reimbursed is one or both of the parents can afford to pay. As soon as you applied for government assistance, they would have gone after the father.

    What I don't understand is why you needed to go on assistance if the father could support the child.

    In any case, once you marry AND the state has been repaid, then the support will stop. But he will need to get a strict accounting to know when to file to stop the support.
