Can you tell me how to do?
    Hi, friend:

I am new here. I am working is USA. In March 2009, I filled the tax income return form and I also applied for ITIN for my wife and my daughter. In June 2009 I got ITIN for my daughter. But my wife' ITIN application was rejected. Then I filled the form and submitted them to the ITIN office and now they rejected my wife' ITIN again. Now I do not know how to do? I am TN visa holder. My wife and my daughter are TD visa holders. My wife cannot work in USA becaure she has the TD visa and now she is studying in USA.

Dear friend, can you tell me how to do for this? Because of this , I still do not get any my income return information.

    Many thanks.

    Bob:

I cannot access my email account (server problems).

Based on our conversation, and since you DO have your daughter's ITIN), you can probably get all of your withheld income taxes back by amending your return to a non-resident return (Form 1040NR) and claim ONLY your daughter as a dependent (residents of Canada and Mexico can claim their children as dependents).

Once you have that tax refund in hand, you can then amend the return a second time to file jointly with your wife and get HER ITIN issued, along with the $1,000 Child Tax Credit.

Did you file W7 forms with your tax return? What was your filing status and which tax return form you filed?
