Okay this is kind of a long question but I really need help.
Two weeks ago my parents went out of town so I had a party at my house. During the party this guy who I know through my friends and pretty well comes up to me and asks if he could use my car to pick up his girlfriend 3 minutes away from my house. I hestitated but he talked about how good of a driver he was previously that day and I specifically asked if he had been drinking at all he denied and I clarified that it was 3 minutes away but asking exactly where she lived and everything. I told him before he left that he better be back in 10 minutes and that I trusted him.
An hour later the party was getting pretty hectic. There was drinking there but the people that were drinking were of age. I didn't drink because I'm not old enough and I wanted to make sure the party stayed in control so as soon as I realized that I haven't heard from the guy yet I made 2 of his best friends call him and he didn't answer.
Two hours later he comes back and I automatically grab my key and just go check on my car. He follows me and doesn't say a word as were walking to it and I notice that my car was in an accident. I have an audi a4 and the whole front was messed up and oil was everywhere I broke down crying. He told me that something came out in front of him and I told him I wasn't stupid and know what hitting something and hitting it pretty hard looks like. I couldn't talk to him and I just ran back to my house crying. My friend kicked everyone out and before the guy who borrowed my car left he told me he would pay for it and he was really sorry.
I told my parents and they called the guy and told him to come over the next day. My dad and him looked at it and he made it clear he would pay for the damage. Following that meeting my dad called the guy's mother who said they didn't have money and since there was drinking at my house and I gave him permission that they don't have to pay.
I was told my the guy who borrowed my car he had a license and was a good driver. Soon to find out he does not have a license or a car so no insurance..
Currently, his mom is not responding to my dads urgent calls and neither is the guy. I've called, tected, and even told his and my friends to tell him to call me and still no response. They agreed to have a meeting with me and their son and I agreed but they never followed through.
Is there anything I can do legally to get them to pay anything. My car is sitting in the shop until I find money and I'm enrolled in two schools and have a job I need help fast. Please email me at >E-mail removed< if you have any advice on what I can do.

He was in the accident and he has to pay for the damage since he does not have any auto insurance. You or your parents or whoever owns the car legally will have to sue the kid and/or his parents in court for the damages. Be sure to get several estimates of the damages and make sure you take lots of photos of the damged auto as well. It's not going to get solved in any big hurry either.

Other than that may I ask you how many times you have kicked yourself in the behind for being so dumb as to have loaned out an expensive car to a deadbeat "friend"?

You report it to your insurance company, they sort it all out, he's the driver and responsible and then you go to Small Claims Court and attempt to recover your deductible and on behalf of your insurance company.

Your company may very well deny the claim for several reasons from unlicensed driver to the consumption of alcohol.

Insurance companies can do basically whatever they want in denying the claim. I didn't bother including the insurance company notification for just that reason. The insurance company may just hike up the other vehicle's premiums due to this if they pay out anything on this claim.

Did you ever notify the police of this accident to see just what your "friend" ran into? There could also be other property damage due to this accident that could come back and bite you, the car's owner. Even though it's been a few weeks, I'm sure that the police would have some record of damages. In the 2 hours that he was gone he could have gone quite a ways away from your home and did some swell damage to either another vehicle or a tree or fence or who knows what else. This could come back and haunt you if someone noted down the make, model and license plate of your car. Your friend seems to think it doesn't matter as it is not his car. He's not going to stay up all night worrying about YOUR car, now is he?
