    Statute of limitations?
    I loan a friend $5,000.00 in the form of a cashiers check on Agust 22, 2007. Since then he has made several payments towards the loan; however, he still owes me $2500.00 and I sent a certified letter requesting the payment of such. What is the statute of limitations in the state of Florida should I need to take him to small claims court? I have heard from friends that it is only two years from the original loan date. Is this true? Thank you!

    Statute of limitations generally goes by the date of the last money he sent you.

    The statute of limitations on debt in Florida puts a time limit on the amount of time you can be sued for a debt.

    Oral Contract: 4 years

    Written Contract: 5 years

    Promissory Note: 5 years

    Open-Ended Accounts: 4 years
