    Sheriff sale at old address
    My daughter is finally seeing a lawyer about filing backruptcy. As soon as she pays him, the paperwork will go through.

    NOW, the address where she USED to live has gotten a sheriff sale notice for Tuesday. She had formerly lived with friends of mine. The sheriff says they are going to sell anything they think might be my daughters and if anything is thiers, they must provide proof (reciepts) and file a paper which costs 70 dollars.There is nothing of my daughters still there. The people have no money for a lawyer, and do not want to lose THEIR things because of my daughter's debt. The sheriff department has been rather rude with my friends, and want THEM to jump through hoops to prove they own their stuff, much of which is older, bought at flea markets or given to them.

    How can they stop this sale, which is tomorrow? This family cannot afford to lose anything they already have...

    It would appear that the time to file motions to stop the sale has passed. The Sheriff's Department might be rude (I don't know what their attitude is) but they are enforcing the law and paperwork as given to them.

    I don't see any good outcome here for your friends.

    The paperwork was just served last week. Legal aid just got off the phone with them 2 minutes ago, and gave them information on how to deal with the sheriff office. Including how to file a certain form so they will not have to pay the filing fee.

    They were rude because they said it doesn't matter whether my daughter lives there or not, that even if she moved a few months ago (which she did) that everything they don't have a receipt for will be sold. When she explained that most of what they own is out of a dumpster, flea market or given to them, they told her too bad then.

    The court order is what they have to enforce, but this gets me really angry because all my daughter's debt came from when she left the army upon finishing her tour in Iraq, and was unable to find a job or even a place to live. They should be thanking her for her service to the country and trying to work with her, not trying to take everything she and her babies have, not to mention the things owned by the people who did give her a place to live when she returned home.
