    Will my PO find out about this?
    Last Friday I violated my probation by drinking, and I ended up in the hospital. Now what happened was, I was picked up by MTA police and detained. According to the hopsital, no charges were made at all, the only thing I had was a hospital release form. Now aside from my PO possibly giving me an ETG test which can detect alcohol for up to 1-5 days after consumption, can he find out about my run in with MTA Police if I was not processed?

    You are required to keep your PO updated - it is your responsibility to tell him/her.

    But I did not commit a crime, therefore I was not booked. Can this still show up?

    You can never be sure what is going to show up. Whether you committed a crime doesn't matter. Do the terms of your probation allow you to drink alcohol, particularly to the extent where you are hospitalized?

    My feeling is that you were detained, your record was run, your PO already has been advised.

    You can always say nothing and hope it is never found out. However, your probation requires you to report these incidents.

    From what I hear, the guys that picked me up almost never run people's names, they just drop them off at the hospital and forget them..

    Well, then I don't know why you're asking. You already have the answer.

    Your PO doesn't know because your name most probably wasn't run by the Police or the hospital.

    You are required to report ALL contact with the police... You were arrested... When your PO checks he's going to find it.

    When I was a PO in Maryland we had something called the ADR system. This stands for "arrest, disposition and reporting." Whenever a person was picked up by the police within the state, an automatic check was made to see if the person is on parole or probation, and if so, a computer-generated notice was sent to the PO advising him of the arrest. As was mentione above, it is a standard condition of probation for the probationer to notify the PO of any new charges.

    I'm not sure how many states have sometime like the ADR system, but I suspect with all the computer technology we have around these days, many do.

    By the way, your belief that you did not commit a crime might not prevent you from being "booked." As long as the police have probable cause to believe that you committed a crime, they can "book" you, according to the Fourth Amendment to the U.S. Constitution.

    I live in Texas and from experience most PO's are very lazy. And don't communicate with PD. If there are no charges then no they won't find out. Stay off the alcohol because you got a free card.
