    I want my deposit back. I didn't even see the apartment!
    :mad:Hello - I went to see an apartment in the state of MD. I was shown an model apartment and was asked to pay for a credit check which I did for $35.00 I paid the credit check and was approved. I was told to come in and pay an additional $300.00 for a deposit. I was also told that my apartment wouldn't be ready until 30 days of July 20th 2009. I asked to see the apartment exactly 5 days after the credit check. I was told that I would not be able to see the actual apartment because it wasn't ready yet. I was told that there is another 2bedroom 2bathroom that is ready to see and ready to move into. I went to take a look and there was roaches everywhere. I also had an witness with me. I told the rental clerk that I was no longer interested in renting from them. Then I was told I would be able to get my deposit back. Then another rep told me that I wouldn't get my deposit back because it was past 72 hours. I didn't even see my apartment. Can they do this? Please help.

    So you paid a $35 deposit without written conditions to the payment and then you changed your mind?

    Yes, I think they can do that.

    I think the poster is asking about the $300 not the back ground check money. If you did not sign the lease you should get this money back.

    You are owed the $300.00 if it was paid for the deposit.
    Submit a request in writing, along with a copy of the check or cancelled check.

    If it gets touchy you might mention that Maryland allows suing for treble damages.

    It depends on the terms of the deposit. If the purpose of the deposit was to hold the apartment for you, then it may very well not be refundable.
