Each state is different. You'd have to check the laws specifically for California. I wouldn't bank on it however ; 16 is awful young and I doubt that too many states will allow a 16-year-old to marry, with or without parental consent, regardless of the circumstances. And although not a legal issue per se, I'm sure a lot of people are going to tell you that 16 is just too young for anyone to be married, period.

Marriage should be the least of your worries considering the age of consent in California is 18.

He can sign the birth certificate.
With all the teen pregnancies I don't see them getting in trouble.
But How old is he? That may make a difference or not.

In some states she could get in trouble, depending on their ages at the time of conception. If she were 18 yrs and 11 months and he had just turned 16 then in most states that is considered statuory rape, regardless of consent. Look up your states guidelines. Mine has a Romeo and Juliet law that protects the two if they were both still in high school etc at the time of conception.

Yeah many states overlook something like this I guess 'the best interest of the child' because how would you feel knowing your mom/dad went to jail over your being conceived.

Yeah - your wedding might very well be in a jail cell. I would see a lawyer, and soon!
