I currently reside in phoenix az I was married in San Antonio Tx. I have lived in Phx for the past 17years. I have been separated from my husband for six years. The first five he was incarcerated. Currently we are not together he does not pay for child support I have 5 children in total three are still minors. My question is if I want to relocate to San Antonio Tx because financially I am over stressed out to the point where it is affecting my health. Can I leave and file for divorce in Texas? My daughter's are 13, 11, and 6 if they agree to leave with me can I leave? At this time my house is three payments past due mosl likely it will go into foreclosure.

Since your still married he could file in Az and force you or the children to return. Many states have a waiting period unless there are emergency situations going on. You might be required to meet the states residency mandates before you can file ( in many that means living there for 6 months )
