    My nephews mom wants to take him to a different state away from my brother.
    Ok so my nephews mom used to live here with my brother and then she got pregnant and wanted to go to Cali to have the baby cause that's where her mom is. My brother was going to meet her there. Well to make this short her and my brother ended up breaking up before my nephew was born. Now my nephew is 10 months old and he has lived here with his mom and my brother for the past 5-6 months. My brother and my nephews mom have been on again off again. Well last night she gets mad at my brother and says that she going to pack up her stuff and go back to Cali. There isn't any kind of custody papers between them or anything. How does my brother keep her from taking his son away again?

    He goes to court this afternoon and files for custody.

    Your brother needs to get a custody order through the court. The court can help decide what's in the child's best interest (I can't imagine moving the baby to a state away from a father that wants to be in that baby's life will be in the best interests.)

    It does, but many courts work on a sliding scale so he may get a reduced or no fees.
