Child's last name change in Pennsylvania/Texas
Hi there all... hoping I can get some help on how to go about changing my sons last name. It's a rather unique situation.
When he was born, his mother and I had just ended a 2 1/2 year relationship, and there was some question of me being the father, therefore, I did not put my name on the birth cert and he did not assume my last name. I got a paternity test and sure enough, he is my little man.
Here's the part that I am having trouble with, at 6 months, she moved with him to Texas(I am in Pennsylvania) after an ultimatum to either be with her or she was moving to be with her family, I called her bluff and she moved. Since then, she and I have salvaged a friendship, actually we are more like best friends. My son is now 7 going on 8 and she is fixing to get married. He comes to Pa all summer and we share holidays. Anyway, I was wondering where I would start the process of changing his name legally to mine. She has no objections to it as she would have liked him to have my name from the start. But because I was 19, immature and bullheaded I've got to take care of it now.
To avoid any confusion to him, I've sat him down and asked if he'd be okay with it and he is actually excited.
Main dilemma being; do I start the process in PA, or should I go through TX? Where/who do I contact to begin the process? I'm hoping no attorney is necessary as money is quite tight at the moment. Also, would they automatically reissue a new birth cert showing me as the biological father? What about Social Security card?
Thank you to anyone who has any incite or can offer up any kind of advice as to where to start!

The process is done in family court where the child primarily resides... so in this case, Texas. It's a simple process if both of you agree and does not require a lawyer. Call the court clerk - there will be a small fee and a bit of paperwork, but its essentially a rubber stamp. After the court orders the name change, you file for new SS cards like anyone changing a name would. The instructions should be on the web site.
