I have a business partner with an existing (for profit) corporation, and I am now in the middle of establishing a 501c3 for a not for profit corporation with her as well.

Her husband is an attorney and handled the paperwork for both corporations.

Stupidly, I did not get a copy of the non-profit paperwork, although I don't recall anything slimy on it...

I do not want to have her as a partner at all , in either corporation, as she's turned out to be a total fraud and basically does nothing. Three years and nothing she has done has worked, and she hasn't really worked at anything anyway.

They (she and husband) are handling the 501c3 (That's the one good thing about her - her husband does everything she doesn't. But... I'm concerned about getting screwed. Nothing I know specifically, just a feeling.

The question is, can I let the filing of the 501c3 continue to be processed, and then dump her later?

Then end them, next always have your own attorney review anything.

But get an attorney, provide them with a copy of all the paper work, if you don't have it, ask for it.

Most states have on-line sites at which you can look up the officers of corporations filed in that state. This would normally apply to non-profit corporations as well as for-profit corporations. If you know what state under which the non-profit was organized, you can look it up and see if you are listed as an officer. If you are a corporate officer you can resign, and that should end your involvement. It shouldn't affect the processing of the 501(c)3 application.
