    Hello,

    My name is Deepika. Im in US on L2 as my husband is in US L1. Currently I have EAD the work permit for L2 and searching job. I also have my H1 B is approved and I have I-797A. However the effective date from when I can start working on H1 B is Oct 1st 2009. Now I came to know that my husbands L1 is though valid until 2011, his term in his company is coming to an end on Spe 25 2009. Can I stay in US after Sep 25 since my H1B effective date is Oct 1st or does it become illegal for me to stay after Sep 25?

    Your H-1B should have been approved with consulate notification and not a change of status. Confirm this on the approval notice I-797. If so, then you will need to leave before your current L-2 I-94 expires and get the H-1B visa issued to you to enter and work as an H-1B.
