    Father trying to take full custody of our 3year old daughter
    I'am 25 years old have a 3 1/2 year old daughter never married her father.He lives an hour away from me.We have an agreement he takes her 4days and I take her 4days we switch on whatever days his 4 days end. I am not working at the time and would like to go back to school.my mom helps with whatever me and my daughter needs. He is not paying child support at the time. He works a full time job as a correctional officer and sometimes does over time where he will be at work all day.He claims because I do not have a job and that he makes a lot more money he has every right to take full custody and saying I'm a unfit mother. My daughter has a place to sleep,eat,and clothes no matter what when she is with me. He has a son same age as my daughter and lives with his mother(not married) So when he is working my daughter stays with his son and his mother. I always meet her to drop and pick up my daughter! So my question is am I an unfit mother? Does he have a chance to get full custody of our 3 1/2 year old daughter? I'am stressing and can't sleep at night since he has said he wants to go to court for full custody! I CAN NOT BE WITHOUT MY DAUGHTER.. any and all advice will be appreciated thank you! :confused::confused:

    No you are not an unfit mother! It is extremely hard to prove someone is an unfit parent. Basically there would have to be some abuse involved.

    I'm assuming that you have never gone to court to formalize custody and visitation. This is a big mistake.

    I suspect that what he is afraid of is that your daughter is nearing school age. Once she starts school, your arrangement of 4 days here and 4 days there will no longer be workable. Sol one of you will have to become the primary custodial parent and the other will have to accept a schedule of weekends and holidays. That also means the non custodial parent will be responsible for child support.

    I urge you to consult an attorney and file for custody ASAP. Do this before he does.
