    Small claims
    After you have won a judgement and the person nerver paid it,can you then take them to small claims court.

    If you have won a judgment you have already taken them to court. You don't need to do it over again, just get a writ of execution from the court which gave you the judgment. With a WOE, you can get a process server to seize their property to satisfy the judgment.

    What state are you in? Some states require the debtor to complete and return a financial disclosure statement, which tells you what their assets and accounts are. You should be able to file for garnishment of wages.

    A writ of execution is a lengthy process and rarely done, especially for a small claims suit.
