    Bank account levy
    My wife has made a payment plan/agreement with a law firm to pay off a credit card debt. The payments are being withdrawn from our checking acct on the 3rd of every month when my wife calls in the check number. My wife's company just switched their payroll period from every two weeks to the 1st and 15th of every month. On 6/3, she contacted the law firm to let them know that the payment cannot be made until the 15th. Today we found out that on 6/4, they levied our acct.

    Since there was an agreement to make payments, will this stand up at the court house to stop the levy? And/or, can the levy be stopped at all??

    Hello s:

    The levy cannot be stopped. They are under NO legal obligation to stick to a payment plan. The judgment they have allows them to take it ALL if they choose. In fact, they were being somewhat reasonable by accepting a payment plan.
