Ex husband not filing taxes
My ex husband is behind in child support by thousands of dollars. The state I live in was forced to become fairly aggressive in obtaining any money from him. To avoid suspension of license/jail etc he rejoined the military. Last year he also remarried. At a court appearance in May of last year he assured me and a states attorney that when he files his taxes that his debt to me would be lowered considerably. He used this as a bargaining "chip" to have less money taken from current earnings to cover the massive debt he owes. A month later he informed me "angrily" that he has no intention of filing his taxes, since " i won't see a dime of it anyway". He receives notices every year letting him know that his taxes will be offset. To my knowledge he has not filed since 2005.
My friend is a CPA who helped me fill out a form that essentially turned him in for not declaring his income. I wrote a detailed summary which included dates etc. I have not heard anything. Meanwhile because of the "con job" he pulled in court his back child support debt is not being reduced. Please advise... If there is number I can call I will call it. I will write letters... whatever it takes. I just want my children to have some of the things they have missed out on because I work too much and their father avoided supporting them financially for 6 years. Please note- when speaking with the states attorney who handled case last year he advised me to start dealing with the IRS. What can I do? I am out of my element.

Contact the IRS raud and Abuse line; you can get the phone number from the IRS website. The sooner you start, the sooner something will happen to fix the problem.

Since your husband has joined the military, you also have recourse by having your lawyer send a letter with copies of your court proceedings to his command. I would also send copies of this letter to the local Judge Advocate office at the base he is stationed and to Defense Financial Accounting Services (DFAS).
If there is a court order for child support, he will be given the opportunity to set up an allotment to you or if he will not do it, the military branch he is in can force an allotment.

ArcherFish is absolutely correct, and, quite frankly, I am upset that I did not recommend it to begin with, as I am a retired Army officer and am fully aware of this procedure.

I have not filed taxes for 2 years (2004, 2005) and I do not have the requisite documentation from those years. I do know that the IRS owed me a refund; I did not owe them any taxes. How does one file without this documentation? And do I need to file these years before I file for 2006?
