Fully Disabled Adult Son (29 yrs old)
    Hello,

I have a 29 year old son who has been fully disabled and basically in a vegetative state since birth. My ex has custody of him. She is taking me back to court for more child support. I am wondering why he should not be covered under "Medicare" or "Medicaid" for pretty much everything. She states he is not eligible for Medicare. She states that his benefits have been cut in Medicaid. She lives in South Carolina and I am wondering what the Medicaid or Medicare rules are in that state for a fully disabled adult child.

    Thanks,

She needs to apply for Social Security Disability for him. Once he receives SSD he will be eligible for Medicaid for his medicine. You can call Social Security yourself and inquire how to apply for him. I am surprised that you are still paying child support for him when he is an adult. You need to consult with an attorney to end your child support obligations for him once the SSD kicks in.

He does get SSI ($674) a month. He has supposedly been getting it for many years. A few years ago (1997) she took me back to court and I was made to pay child support for life. His or mine... whichever comes first. Now they have ruled I have to pay $528.67 per week! So every two weeks that leaves me with $490 to live off. She claims she has $5300+ each month in extraordinary uninsured medical, child care.. etc... This can not be correct since he supposedly gets Medicaid also. I feel like I am being taken to the cleaners and have no way to protect myself.
