    Security at Town House Condo
    I live in a town house condo complex which has a condo board and is run by building management. I pay a maintenance fee on a monthly basis. With maintenance comes washing of windows (once per year), a security guard, video surveillance, snow removal, etc.

    Not too long ago I parked my car in the underground garage. Someone decided to “egg” my vehicle. The damage to my car was quite significant as eggs can be quite corrosive to paint.

    I called security, and then the police. I let the police know that there is a security camera which is monitored by the security office, so they should be able to id the culprit from their tapes. Security then notified me that the security system hasn’t been working for approx. 7 to 8 years. I was mortified to say the least. I would like the condo board to pay for the damages to my car. What steps can I take in order to have a strong case against the board for their negligence?

    Do you have any documentation that specifies what your maintenance fees go towards?

    If you do then you can probably sue. At which point everyone's maintenance fees will go up to pay for the repairs/upgrading of the video equipment.

    Hello f:

    Suing in small claims court is quick, cheap and easy. All you need to do is go down there.

    Take pictures of your car, your agreement that says what they'll provide, and subpoena the clerk who told you the surveillance stuff didn't work.

    Unless stated or claimed in your lease or their promotions as having security survalience you have no claim that I can see. The damage would have been done camera or no, so they did not cause the damage but made it harder to find the culprit. I own a facility that has one camera and 6 dummy cameras. A dummy or faulty camera produce similar deterrence effects.
