No, you cannot, unless your son is eligible for a SSN and you just have not yet applied.

Thanks for reply, your answer leads me to my next question related to this, I am on L1, My wife and son on L2,
I was able to get SSN for my wife on the basis of "Marriage certificate", But when I applied SSN for my son, the application was not accepted, the reason give was "he is not eligible"

Can you please confirm whether this is true ?

    Thanks

Yes, that is true. Your son is NOT eligible for a SSN, and, to be frank, I am surprised your wife got a SSN.

You can get the RRC of $1,200 for yourself and your wife. You just cannot get the extra $300 for your son. You can claim him as a dependent and submit Form W-7 to get him an ITIN, but that will only allow you to claim him as a dependent (and qualify him for the $1,000 Child Tax Credit).

If you need professional help to do all this, email me at [email protected].

Both your wife and son are not eligible for SSN. Yes, it is a surprise that your wife got SSN.

If your son was in the U.S. in 2008, then you can claim him dependent on your 2008 tax return. He will not get recovery/stimulus rebate.
