    L1 Visa : taxing procedure
    Hi

    I was transferred to one of the subsidiaries(in U.S) through one of my company (in India) on L1 visa and arrived here on December,2008.

    My parent company back in india is paying me money as a form of allowance of 3700(excluding Taxes) and I am a bachelor.
    I currently do not have a W2 .
    Following are my questions:
    1.) How Do I go about paying taxes in US ?
    2.) Am I entitled to pay tax for the last year ?

    Did you get any income in the U.S. from the U.S. company in 2008?

    No , My employer in India has paid me for the tenure of 2008.

    In 2008, you are nonresident in the U.S. If you did not earn any income in the U.S. you will not file any tax return. Also, if the income is less than $3,500, then it is below the filing requirement.

    I have to disagree in part with Mukata's response.

    Since you are being paid through a U.S. subsidiary of your parent Indian company, your income is in fact considered to be U.S.-sourced and IS subject to U.S. income taxes.

    It may not affect your 2008 tax filing requirement, because if your 2008 income was below $3,500, there was no filing requirement.

    However, for 2009, you WILL be obligated to file a U.S. income tax return for income earned while within U.S. borders, even if you stay less than 183 days.

    If you stay beyond 183 days in 2009 (past 2 July 2009), then there is no doubt that you ARE liable for U.S. income taxes for 2009.
