    I'm the kid, parents divorced, need to know my rights
    Hi, my parents are divorced. My dad lives at least a few hundred miles away. I'm over 12 years old and I want to live with my dad now, but one of my family members is under 12 so I can't move up with him because the court won't split up siblings. My mom also won't let me visit him during the summer when I can, do I have any rights of when I can see him??

    You really don't have any rights. Sorry,. that's harsh but until you are 18 you are at the whim of the court.

    Your father can file for custody change, but unless there is a compelling reason, a court is unlikely to change anything.

    Your father needs to file for visitation to nail down exactly when he gets to see you. Your mother does not have the right to deviate from THAT court ordered schedule.

    Your father has rights and your mother has rights,

    First you can't even decide where to live at 12 unless your dad takes it back to court.

    Your dad also has to request visitation though the courts, if he has it already, he needs to go to court to force it if mother will not allow.

    So your dad can demand what the court order says

    Your rights are slim. You have the right to food and clothing and a roof over your head supplied by your parents until your of age. You have a right to a safe environment as best can be provided. Other then that you don't have the same rights.. nor responsibilities as an adult.
