    Fired after getting surgery
    So I live in Arizona to start with. I recently had surgery and while I was in the hospital my employer had sent me a letter stating that my "work ethics" were the reason. The only thing I can think of for that was some hearsay that was resolved. I do remember one day I was checking my email at work but I was on my lunch break and didn't want to leave the phones to go to the answering machine. When the doctor I worked for walked in I didn't want to tell him,"Hey I am on my lunch break so I can't talk." That wouldn't be very professional. I just can't find any other reason for them firing me except that I would be out of work for 3 days. When I took a day off when my son was sick they didn't "appreciate" that as they said. I know that it is not legal but how can I go about getting this taken care of with unemployment and such? Any suggestions?

    Apply for unemployment benefitsf ASAP & if you are denied APPEAL the decision . You have a valid reason for being out of work. Did you file a FMLA @ work prior to surgery?

    I did apply for unemployment and I am currently getting a lawyer. I did not file a FMLA prior to surgery because it was same day emergency surgery. Thanks for the reply.

    Great idea getting a lawyer.The chain of command was not followed prior to your dismissal. They did not have good cause,& it is not legal. Your hospital records will be the proof you need for your claim. If any lawyer tell you that you have no claim, find another lawyer, & KEEP LOOKING until you find one who will. GOOD LUCK.
