    Verbal agreement.Binding or not?
    My friend lost her job and couldn't afford to make her jeep(a second vehicle) payments anymore. I needed a vehicle for work because my ex got the car in our settlement. She and I made a verbal agreement that I would take over her jeep payments and insurance payments until paid off. After several months of me making the payments, she decided she wants the jeep back so her new girlfriend can use. I told her we had an agreement and she can't do that because it's a binding contract. She told me that I have until the end of the month to return the vehicle. Is this an issue I should fight over? Due to other issues, I can't finance a vehicle in my own name right now. But without a vehicle I could lose my job. Any advice?

    Do you have cancelled checks that show you paid the loan and insurance? If so, you should have enough to prove the agreement.

    I would send a letter to the friend stating the agreement and that you have proof that the agreement existed. Tell her you have no intention of turning over the vehicle since you need it for your job.

    If she doesn't like it tell her to sue.

    I do not have the canceled checks. I paid in cash at the financial institution where she has her loan, but I made sure that I got a receipt every time. Not that I foresaw this happening, but as a way to prove that I can make payments if I ever get back on my feet enough to be able to get a loan on my own.

    Do the receipts show the loan #? Why don't you pay by check?

    Yes the receipts show the loan number, and I don't have a checking account in my name right now, because of my ex. I don't have credit cards either, and never worried about money orders because I was paying at the bank where she had her loan. We live in a small town and everyone knows everyone so its not like I'm a stranger to the people at the bank making her payments. Plus they know I'm driving her jeep because I'm making her payments. I'm sorry this is complicated to express. I just want to know what my options on trying to keep the vehicle are basically. Thanks for the help

    As long as you have proof that you are making the payments, that will provide proof of the verbal agreement. Why would you make the payments if you didn't have such an agreement.
