    Dicorce and property and immigration
    Hello:

    I got married approximately 5yrs ago to my husband. I am a US citizen and he gained his legal rights in th US through our marriage, currently he holds a permanent resident card.

    We are currently separated and I will be filing for a divorce soon but I was wondering what will happen to his legal status if I file for a divorce?

    Also, I bought a house with my father during the time I was married. Can he ask for the house during the divorce. No pre nub was signed at the time we got married. His name is not on the morgage/deed/title and he has absolutely nothing to do with the purchase of the house. He never lived in the house. My parents and I are the primary residents of the property now.

    I doubt after 5 years of marriage your husband will have INS problems.

    As to the house, depending on where you live, whether your husband has an interest in it may depend on whether he signed a quitclaim deed when you bought it. If not, your husband may have a claim to one-half of your equity interest in the property, if there is any.

    Depending on the laws in the state you live, as pertains to community property state or not will determine if the house is marital property. Usually, all assets acquired during the marriage are considered marital property and subject to division at divorce.
