    Dependent ITIN is required for 1040NR?
    Hi,

    I was in US (BL-1 visa) from sept 6, 2008 to Feb 1, 2009. For the TY08, I should consider only up to Dec31, 2008 and therefore I need to file 1040NR. Correct me if I'm wrong.
    I was in US with my Wife and son but did net get their ITIN. We are back to India now.

    My question is, can I show them as dependent in 1040NR and get some tax benefit? I under this requires I need to file W-7 for both of them along with 1040NR.

    Secondly, when I compared 1040ez with 1040NREZ, I found that std deduction in more in 1040ez ($8950 for single) than 1040NREZ ($3500). Is this correct? If not why is this difference. I saw in some document from IRS stating the tax is same for resident as well as non resident.

    Hi,

    I need to file the tax return by the 15-apr-2009. My wife and kid don't have the ITIN numbers. I came to know that it will take 5 to 6 weeks to get the ITIN numbers. My question is :

    Do I need to wait for ITIN numbers to file the returns ?

    What is BL-1 visa for? Are you an employee?

    Sarjapr need to file Form 1040NR with Form 2106 to claim daily living expenses. He was not in the U.S. long enough to qualify to file jointly with his wife as resident aliens.

    Prani0703 files the Form W-7 with the 2008 IRS tax return! The IRS will issue the ITINs, insert them in the blank SSN areas for the wife and child, then process the return.

    Rimpy, if you submitted the W-7 by itself, it will be rejected with instructions that you submit the W-7 with the 2008 tax return.
