    Trespassing vs shoplifting charge in canada
    If caught shoplifting, why would the store charge the person with trespassing instead of stealing? Are both criminal charges?

    If they felt you had a very good chance at beating the shoplifting charge because they felt your story would have a better chance then they will go with one that is more sure to stick.
    In ,y state shop lifting under $5,000. Is a summary offense or at least treated that way.

    I am not sure what the circumstances they could claim trespassing unless the person was banned from the store or they broke in.

    In most cases they will charge you with everything they can hoping at least one or two charges stick.

    Sure when a crime happens they will get any and all videos they can to use them to prove their case.

    Why not? If the video captured the incident, then it can be subpeonaed for evidence.
