    Tax return on OPT
    One of my previous employer was deducting SSN and Medicare tax from my pay check, I was working on OPT for that employer from Jan 2008 till March 2008.

    I have asked him to refund the money and he said he can't. Now I am filing form 843 and 8316 with copies of I-20, OPT card, F1-Visa and I-94. Did I miss something?

    Do I need to file 1040-NR to claim federal tax return? As I worked on OPT in 2008. Do I need to file 1040-NR before filing form 843 and 8316? Do I need to attach 1040-Nr with 843 and 8316?

    I am confused with this. I will appreciate any help on this matter.

    Form 843 must be filed separately.
    But it is better that you first file your nonresident tax return for 2008.

    I am an international student. I am currently working on OPT. Should I file 1040-NR or 1040EZ-NR?

    Do not forget to file the Form 8843. If you did forget, fill it out, sign it and mail it separaretly to:
