    What my child wants
    My ex husband and I have an 8 year old son together. His father has full custody of him,but he wants to live with me.I am about to move to Florida and my son wants to live with me but his father will not even consider it.his father got custody of our son because he was in the appropriate school zone at the time.my son was 4 at the time.my son is terrified to confront his father about living with me. And we cannot seem to have a nice conversation beond 2 minutes.I am considering taking my son with me without his fathers consent.what I need to know is what am I facing if I do this once in Florida.

    Kidnapping charges for one. As a child grows older, most courts give their wises some weight in making custody changes/determinations. The best way to handle this is through family court, sometimes with mediation the parents can come to an agreement that satisfies the needs of everyone while meeting the best interest of the child. If the father has legal custody and you take the child to Florida without the father's consent, that is Kidnapping. Don't do it.

    As far as him getting custody just because of school zone, that sounds like a loaded one to me. There must be reasons he got custody instead of you. You even considering to take him without fathers consent shows that your capable of kidnapping.. Which is punishable by law. Do not do it. You will only lose your son for life.

    I will call it also, custody for a school zone, pure bull, sorry but that has so little to do with it, parents from the inner city in the worst school districts get custody of their kids.

    But the issue here is, even if you had custody, you still can not just move unless he agrees, since it would interfere with his visits.

    But he has custody, so you would be at best, interfering with custody, and at worst kidnapping, depending on how your state rights the laws.

    In either case, you would be in jail, most likely lose visits rights at least for a while, and then end up with only supervised rights.

    So if you want to end up in jail, with never seeing your son, go for it.

    And even if you went to court and got custody, you still can not move out of state without fathers permission
