    Hi ,
    We came in December 7th 08.I am on H1 visa .My wife is on H4 .

    You file as a non-resident alien, filing Form 1040NR or 1040NR-EZ. You do not qualify to file jointly with your wife because you have NOT being in the U.S. for at least 31 consecutive days in 2008.
