    Hi,

    I would like to ask you some questions regarding a divorce case, to see what is the best way to deal with it.

    I am US Citizen, living in Virginia (Loudoun County) and went pack to Pakistan to get married and we got married in July 2006 and my wife came to US from Pakistan in Oct. 2007. We got separated in April 2008. On separation she went to her uncle house in TX. She came back to VA and we signed a Property Settlement Agreement (PSA) in Aug. 2008 with addendum (saying that I will return her all the things that I will found) and soon after she went back to Pakistan without telling me. We don’t have any kids. I tried to serve her (after 6 months of physical separation) at her last known good address in TX and sheriff came back saying she was in not in the country anymore. Before I serve her by police I serve her personally the divorce papers as we decide to do it peacefully but when they never replied I try to do it through police and there I found out that she is not in country anymore. Paper I send her personally have return receipt with her uncle signature that they accepted it. Does that have any court importance? Later, I was about to do divorce by order of publication, but then she replied to court basically asking for her remaining things and for all of her communication to be sent to an address in Pakistan . Now I am not sure how to deal with this internaltional stuff and how to return her stuff so I can proof to court that I have return her stuff whatever I have found.

    I started trying to do the divorce on my own, as she also agreed to do the remaining divorce part as nicely as possible. Once she replied to court from Pakistan I hired a lawyer, but he has never dealt with an international case like this. So now I want to know what should be my next step. I am in a condition where I might have to step in and help lawyer to keep this this moving.

    How to serve in Pakistan?
    Hi,

    I am in the divorce process with my spouse and I want to know how to serve her in Pakistan? Some people says regular certified mail is OK and some says need to more than that. I read through Google that there is some document/rule which tell how to serve people in countries in divorce process.

    Does any one knows how to serve in Pakistan or what is the right way to serve spouse in Pakistan?

    Is your wife in the military? Are there any children?

    You can't wait until she returns from Pakistan to do this? Why?

    If she is military, you may have to work through the military to have her served. I would suggest that you start by talking to a base Chaplin.

    Hi,
    No she is not in military and she does not have any plans to come. I have asked her if she plans to come back as on green card you can only live one year outside of USA but she said no she is not coming back and she wants all of her divorce communication to be send to her Pakistani postal address.

    I would suggest that you contact the U.S. State Department or U.S. Immigration to see how you need to handle this.

    One issue I can think of is whether Pakistan will allow divorce?

    The reason I opened two posting is that I do not want to buried too many questions in one posting as I am new here.

    Yes, pakistan will allow the divorce. Actually I am sure that my wife have done divorce process in Pakistan called Khula (which is basically tells that divorce is filled by wife instead of man) but as there are not sny electronic or organized record available of this stuff so it is very impossible to get it without knowing where it was register and what is Khula number. Which I am sure my wife will not tell me. So I am pretty much out of luck there.
